These Terms of Service ("Terms") govern your use of themellowsf.com and its pages (the "Site"), operated by TheMellow LLC, doing business as The Mellow SF ("The Mellow SF," "we," "us," or "our"). By visiting or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About This Site

The Site is informational: it describes our coffee bar, Mellow Nights (live music), private events, Lakehouse Jazz, Mellow & Barbers, workshops, and our story, and it offers two contact forms. The Site does not sell anything and does not process payments, and it has no user accounts or logins.

These Terms cover themellowsf.com only. Other sites and apps connected to The Mellow SF family of businesses, including nights.themellowsf.com, our coffee ordering app, mellowandbarbers.com, and third-party platforms such as Eventbrite (ticketing) and Airbnb Experiences (Lakehouse Jazz), are separate from the Site and have their own terms of service and privacy policies. Please review those directly.

2. Eligibility

By using the Site, you represent that you have the legal capacity to agree to these Terms. If you are using the Site on behalf of a company or other organization, you represent that you have the authority to bind that organization to these Terms.

The Mellow SF welcomes all ages. You must be 21 or older to purchase or consume alcohol, as required by California law. This Terms of Service page does not set any other age requirement for using the Site itself.

3. Permitted and Prohibited Use

You may use the Site to learn about our offerings and to contact us. You agree not to:

Scrape, data-mine, or use automated means to collect content from the Site beyond normal search-engine indexing;
Submit spam, unsolicited advertising, or abusive, fraudulent, or unlawful content through our contact forms;
Attempt to interfere with, disrupt, or gain unauthorized access to the Site or the systems behind it; or
Use the Site in any way that violates applicable law.

We may block or restrict access to the Site for anyone we reasonably believe is violating these Terms.

4. Forms and Communications

The Site has two forms: a private events inquiry (asking for your name, email, company or team, preferred date or rough timing, headcount, which experience you're interested in, and a message) and a general contact form (asking for your name, email, a topic, and a message). Submissions are delivered by email through SendGrid, our email delivery provider: the private events inquiry goes to our events team, and the contact form goes to hello@themellowsf.com.

By submitting a form, you consent to being contacted by us about your inquiry or message, using the contact information you provided.

Submitting a private events inquiry is not a booking and does not create a commitment by either side. Any private event is confirmed only through a separate written agreement between you and The Mellow SF.

5. Accuracy of Information

We try to keep hours, lineups, menus, and prices on the Site current, but they can change without notice, and we do not guarantee that everything on the Site is accurate, complete, or up to date at any given moment. Where ticket sales, prices, or bookings happen on a third-party site (for example, Eventbrite for Mellow Nights and Lakehouse Jazz tickets, or mellowandbarbers.com for barber bookings), that third party sets and controls its own pricing and availability, not us.

6. Third-Party Links and Services

The Site links to third-party sites and services we don't control, including ticketing platforms, our coffee ordering app, our barbershop partner's site, Lakehouse Jazz on Airbnb Experiences, and our Instagram and YouTube accounts. We are not responsible for the content, policies, or practices of any third-party site, and linking to it is not an endorsement of everything on it. Your use of any third-party site is governed by that site's own terms.

7. Intellectual Property

The Mellow SF name, logo, photography, written content, and the design of the Site are owned by us or used under license, and are protected by applicable intellectual property laws. We grant you a limited, revocable license to view the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, or create derivative works from the Site's content without our prior written permission.

8. User Submissions

Anything you send us through a form on the Site (your name, contact details, and message) is yours, but by sending it to us you give us permission to use it to respond to you, process your inquiry, and keep records for our business purposes as described in our Privacy Policy. Please don't submit anything through our forms that is unlawful, that you don't have the right to share, or that contains someone else's confidential or personal information without their permission.

9. Disclaimers

The Site and the information on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, The Mellow SF and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Site. Because the Site does not sell anything or process payments, our total liability to you for any claim arising from your use of the Site is limited to the greatest extent permitted by applicable law.

11. Indemnification

You agree to indemnify and hold harmless The Mellow SF and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

12. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect when we post the updated Terms on this page and update the effective date above. Your continued use of the Site after a change is posted means you accept the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Accessibility

We aim for the Site to meet the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter an accessibility barrier on the Site, please let us know at hello@themellowsf.com so we can address it.
