This Privacy Policy explains how TheMellow LLC, doing business as The Mellow SF ("The Mellow SF," "we," "us," or "our"), collects, uses, and protects personal information when you visit themellowsf.com and nights.themellowsf.com (together, the "Site"). By using the Site, you agree to the practices described below.

This Privacy Policy covers themellowsf.com and nights.themellowsf.com, our live music site, which means its calendar, drink menu, and show archive. Tickets for Mellow Nights shows are sold through Eventbrite, under Eventbrite's own privacy policy. The tools we use ourselves to manage the calendar and archive are for staff only, are not part of what visitors see, and collect nothing from visitors. Other sites and apps connected to The Mellow SF family of businesses, including our coffee ordering app, mellowandbarbers.com, and third-party platforms such as Eventbrite and Airbnb Experiences, are separate from the Site and have their own privacy notices. Please review those directly.

1. Information We Collect

Information you give us. themellowsf.com has two forms. The private events inquiry form collects your name, email, company or team, preferred date or rough timing, headcount, which experience you're interested in, and a message. The general contact form collects your name, email, a topic, and a message. nights.themellowsf.com has no forms and does not collect information directly from visitors.

Information collected automatically. Our web server logs record IP addresses and browser details for every visit, as most websites do. For spam prevention, we also generate a short-lived, one-way cryptographic hash of your IP address (which cannot be reversed back into the original address) and use a hidden "honeypot" form field together with a timing check to filter out automated submissions.

Hosting and infrastructure. The Site is hosted on a DigitalOcean server located in the United States. Cloudflare sits in front of the live Site for security and performance, which means Cloudflare also sees visitor IP addresses as part of providing that service.

2. Cookies and Similar Technologies

On themellowsf.com, the Site itself does not set any cookies. It uses your browser's local storage only to remember a couple of on-device preferences, whether you've turned motion effects off, and some page-transition state, and neither of these ever leaves your device. nights.themellowsf.com sets no cookies of its own beyond what Google Analytics sets, as described below.

On the live Site only (never on our staging or test sites), we run Google Analytics 4, which does use cookies. On nights.themellowsf.com, the Google Analytics tag also anonymizes IP addresses. Google Analytics helps us understand which pages are viewed, general device type, and approximate location. You can opt out of Google Analytics using Google's browser add-on or through your browser's own cookie settings.

If the "What's playing at the shop" section is on the page, your browser also requests a small file from our own third-party host, nowplaying.themellowsf.com, to show what is currently playing. Nothing about you is sent with that request, and it does not use cookies.

3. How We Use Your Information

We use the information described above to:

Respond to your private events inquiry or contact form message;
Operate, secure, and troubleshoot the Site, including preventing spam and abuse;
Understand how visitors use the live Site, through Google Analytics; and
Comply with applicable law.

4. How We Share Your Information

We do not sell your personal information, and we do not use advertising or retargeting pixels, sell or share personal information for advertising purposes, or work with data brokers.

We share information only with the service providers who help us run the Site: our email delivery provider (SendGrid), our hosting provider (DigitalOcean), our security and content delivery provider (Cloudflare), and our analytics provider (Google Analytics), and only so they can perform those services for us. We may also disclose information if required by law, or in connection with a merger, acquisition, or sale of business assets.

5. Data Retention

We keep messages submitted through our forms in our email inboxes for as long as reasonably necessary to respond to you and to operate our business, and delete them when they're no longer needed. Server logs are rotated on a routine basis as part of normal system maintenance.

6. Your Privacy Rights (California Residents)

If you are a California resident, the California Consumer Privacy Act and California Privacy Rights Act (CCPA/CPRA) give you the right to:

Know what personal information we have collected about you;
Request deletion of your personal information;
Correct inaccurate personal information; and
Opt out of the sale or sharing of your personal information (as noted above, we do not sell or share personal information for advertising).

You will not be discriminated against for exercising any of these rights. To make a request, email us at hello@themellowsf.com; we will respond within 45 days. We honor Global Privacy Control (GPC) signals as a valid opt-out request. Under the California Online Privacy Protection Act (CalOPPA), we note that we do not currently respond to browser "Do Not Track" signals, though we do honor GPC as described above.

7. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). If you are a parent or guardian and believe your child has given us personal information, please email us at hello@themellowsf.com and we will delete it.

8. Security

We use reasonable administrative, technical, and physical safeguards to help protect your information. No method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

9. International Users

The Site is based in the United States and your information is processed here. By using the Site, you consent to the transfer and processing of your information in the United States.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes take effect when we post the updated policy on this page and update the effective date above.
